Shipping policy

This Policy explains how products purchased from babalu.pt are prepared, shipped and delivered.

The selling entity is Luís Miguel da Costa Ferreira, NIF/VAT PT219263752, which operates under the brand name BABALU Fishing Tackle, hereinafter referred to as “BABALU”.

This Policy supplements the Terms of Service and does not limit any mandatory consumer rights.


1. AVAILABLE DESTINATIONS

BABALU currently accepts orders for the destinations available in the store's active markets:

  • Portugal;
  • European Union countries included in the store's delivery configuration;
  • United Kingdom;
  • United States;
  • Canada, including the 13 provinces and territories and Quebec.

Availability depends on product, stock location, full address, carrier restrictions and destination country rules. A country shown in the market selector may not be available for all items or zip codes.

Norway is in preparation and is not considered an active market until the delivery option is published in the store.

2. CALCULATION OF POSTAGE

Shipping methods and costs are calculated based on cart contents, weight, quantity, stock location, country, region, province or state, zip code and available services.

To get an estimate in your cart, enter the correct country, region or province, and zip code. The definitive value and the methods actually available are presented during checkout, before order confirmation.

BABALU does not currently apply a general free shipping rule. Any future free shipping campaign will only be applicable when expressly presented on the website and in the conditions of the campaign itself.

3. PREPARATION AND SHIPMENT

Orders are normally prepared within 3 business days after payment confirmation, unless otherwise stated on the product page or during checkout.

This deadline does not include Saturdays, Sundays, holidays, transportation time or delays caused by payment validations, incomplete information, security checks or exceptional circumstances.

BABALU uses its fulfillment network, which may include logistics services from Amazon and other carriers or providers. The order may be shipped from a location other than the BABALU headquarters, depending on stock and destination. The specific origin of the shipment does not alter the identity of BABALU as a selling entity nor the rights of the customer.

4. DELIVERY TIMES

The deadlines shown in the cart or during checkout are estimates calculated for the selected method and destination. The deadline applicable to the order is that indicated at the time of purchase, unless a subsequent update is communicated to the customer.

Estimates may be affected by periods of increased demand, weather conditions, customs inspections, holidays, local restrictions, carrier incidents or other circumstances beyond BABALU.

If BABALU cannot meet an agreed date or an applicable legal deadline, it will inform the customer and provide the options required by the legislation of the respective market. Nothing in this section limits the consumer's right to set a reasonable additional period, terminate the contract or obtain a refund where the law allows.

5. ORDER TRACKING

When the shipping method provides tracking, the customer will receive an email with the tracking number or link after shipping. The information may take some time to become visible in the carrier's system.

The “shipped,” “in distribution,” and “delivered” notifications reflect updates received from the carrier. If the information remains unchanged for an abnormal period of time or shows a delivery that did not occur, please contact hello@babalu.pt.

6. SPLIT ORDERS

An order can be divided into several shipments when the items are in different locations, have different availability or the division is necessary to complete the delivery. In this case, the customer may receive multiple tracking numbers and deliveries on different dates.

Unless expressly indicated before purchase, the division decided by BABALU does not increase the total shipping already confirmed in the order.

7. ADDRESS AND DELIVERY DETAILS

Customer must provide a complete and correct address, including name, house number, apartment or unit, city, region, province or state, zip code, country, telephone number and any necessary instructions.

If you notice an error, contact hello@babalu.pt immediately. BABALU will attempt to correct the address prior to dispatch, but cannot guarantee changes once processing has begun.

If an order is returned due to an incorrect or incomplete address, unjustified refusal, repeated absence or failure to collect, new postage and reasonable costs actually incurred may be charged, when legally permissible. This rule does not apply when the failure is attributable to BABALU or the carrier, nor does it reduce the consumer's mandatory rights.

8. APARTMENTS, REMOTE AREAS AND RESTRICTIONS

Delivery to PO Boxes, military bases, remote territories or addresses with restricted access depends on the carrier and the service available. Checkout may refuse an address or present different methods and deadlines.

BABALU may be unable to ship certain products to a destination due to legal, customs, security or carrier restrictions. If a restriction is only identified after ordering, the customer will be informed and will receive a refund for items that cannot be shipped.

9. TAXES, CUSTOMS DUTIES AND IMPORT CHARGES

Before confirming the purchase, the checkout displays the price, taxes, shipping and other charges charged by BABALU according to the applicable market and configuration.

When customs duties or import taxes are calculated and charged at checkout, they will be included in the total displayed. When not charged in advance, the authorities or carrier of the destination country may require the recipient to pay taxes, duties, customs clearance fees or other charges before or after delivery.

The customer is responsible for checking the destination's import rules. BABALU does not control charges imposed directly by authorities or carriers, but will provide commercial information reasonably necessary for customs clearance. No mandatory costs charged by BABALU will be hidden or added after order confirmation.

10. RISK OF LOSS OR DAMAGE

In sales to consumers, the risk of loss or damage is transferred to the consumer when the consumer, or a third party indicated by the consumer other than the carrier, acquires physical possession of the goods, unless mandatory market legislation determines another solution.

If the consumer directly hires a carrier that has not been proposed by BABALU], the risk may be transferred at the time of delivery of the goods to that carrier, in accordance with applicable legislation.

11. DELAY, LOSS OR DAMAGE DURING TRANSPORTATION

If your order is delayed, please check the tracking link first and confirm the address. If the estimated deadline has been significantly exceeded, please contact hello@babalu.pt with your order number.

If your order arrives damaged, photograph the outer packaging, shipping label, interior and items before disposing of any material. Send photos and order number to BABALU as soon as possible.

BABALU will deal directly with the carrier whenever it is responsible for delivery and will provide the legally appropriate solution, which may include new shipment, replacement or refund. The customer is not obliged to resolve a claim against the carrier alone when responsibility for transportation belongs to BABALU.

12. DELIVERY MARKED AS COMPLETED

If the tracking indicates that the order was delivered, but you cannot find it:

  1. confirm the address indicated in the order;
  2. check the mailbox, secure areas, reception, concierge and other usual locations;
  3. ask people in the household, neighbors or those responsible for the building;
  4. wait until the end of the day, as some carriers register delivery before the route is completed;
  5. contact BABALU if the order is still out of stock.

BABALU will analyze the delivery record and open the necessary investigation with the carrier. This analysis does not limit the consumer's legal rights.

13. CANCELLATION BEFORE SHIPMENT

If you wish to cancel an order, please contact hello@babalu.pt immediately. BABALU will attempt to stop processing, but cannot guarantee cancellation once the order has been prepared or shipped.

If cancellation is no longer possible, the customer may use the rights described in Returns and Refunds Policy.

14. FORCE MAJEURE AND CONTINUITY OF SERVICE

BABALU will not be responsible for delays caused by unforeseeable or unavoidable events beyond its reasonable control, to the extent permitted by law. Wherever possible, it will inform the customer and take reasonable steps to reduce the impact.

This provision does not eliminate the right to refund, termination of the contract or other remedy when required by applicable law.
